1. Agreement to Terms

By accessing or using PlanPlate.ai ("Service"), operated by Opencream SASU, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

PlanPlate.ai is a recipe management and transformation service that helps users organize, import, and manage recipes from various sources. The Service uses AI technology to process and standardize recipe content.

3. User Accounts

Account Creation

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your account information
• Keep your password secure and confidential
• Be responsible for all activities under your account
• Notify us immediately of any unauthorized access

Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activities.

4. User Content

Your Recipes and Data

You retain all rights to recipes and content you upload to the Service. By uploading content, you grant us:

• A license to store, process, and display your content to provide the Service
• Permission to use AI to analyze and transform your recipes
• The right to create backups of your data for service continuity

Content Restrictions

You agree not to upload content that:

• Violates any intellectual property rights
• Contains malicious code or viruses
• Is illegal, harmful, or offensive
• Violates any applicable laws or regulations

5. Acceptable Use

You agree to use the Service only for lawful purposes. You must not:

• Attempt to gain unauthorized access to the Service or related systems
• Use automated systems to scrape or collect data from the Service
• Interfere with or disrupt the Service or servers
• Impersonate any person or entity
• Reverse engineer or attempt to extract source code

6. Third-Party Content

When you import recipes from third-party websites (TikTok, Instagram, etc.), you are responsible for ensuring you have the right to use that content. We provide tools to import publicly available recipes, but you must respect the original creators' rights and terms of service.

7. Subscription and Payment

Pricing

PlanPlate.ai offers a free tier and a paid Premium subscription. Prices and features may change with notice; the price shown in the App Store when you subscribe applies to that subscription. Current pricing is available at planplate.ai.

Free Trial

Premium starts with a 7-day free trial. If you do not cancel before the trial ends, your paid subscription begins and you will be charged. You can cancel at any time during the trial to avoid the charge.

Billing

When you subscribe:

• Subscription fees are charged by Apple through your Apple Account, and Apple's terms apply to payments
• Please keep the payment method on your Apple Account up to date
• Your subscription renews automatically unless you cancel at least 24 hours before the end of the current period
• Refund requests for App Store purchases are handled by Apple under its policies. Nothing in these Terms limits any refund or withdrawal right you have by law

Cancellation

You may cancel your subscription at any time in your Apple Account subscription settings. Your access continues until the end of the current billing period. This does not affect any rights you have by law as a consumer, including any right of withdrawal.

8. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Opencream SASU and is protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our explicit permission.

9. Disclaimers

Service "As Is"

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Accuracy or reliability of content
• Uninterrupted or error-free operation
• Fitness for a particular purpose
• Non-infringement of third-party rights

AI-Generated Content

Recipe transformations are generated using AI technology. While we strive for accuracy, AI-generated content may contain errors. You are responsible for reviewing and verifying all recipe content before use.

10. Limitation of Liability

To the maximum extent permitted by law, Opencream SASU shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or use, arising out of or related to your use of the Service. Nothing in these Terms excludes or limits liability that cannot be excluded by law, including liability for intentional or grossly negligent acts or for injury to life, body, or health, or your statutory rights as a consumer.

11. Indemnification

To the extent permitted by law, you are responsible for claims, damages, and losses that Opencream SASU suffers because you violated these Terms or the rights of third parties.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by French law. If you are a consumer, you keep the protection of the mandatory consumer laws of the country where you live, and you may bring a claim before the courts of that country.

14. Consumer Mediation

If you have a dispute with us as a consumer, please contact us first. If we have not resolved it to your satisfaction, you may use consumer mediation free of charge with the following mediator:
